TERMS AND CONDITIONS
1 INTRODUCTION .
This document establishes the General Conditions (hereinafter, the "Conditions") governing the purchase of products through the URL www.meermin.com (hereinafter, the "Website" ) , owned by MEERMIN 1951 SL with NIF: B57068413 and company address at Calle Sabaters 27 , Polígono Industrial Can Matzari , 07300, Inca, Islas Baleares (hereinafter “MEERMIN” or the “Owner”).
The user of the Website (hereinafter, the "User") must carefully read these Conditions before placing an order through this Website . When placing an order, marking the box for acceptance of these Conditions in the purchase process , implies express acceptance and binding to these Conditions by the User .
In accordance with the provisions of article 23 of Law 34/2002, of July 11, on services of the information society and electronic commerce, contracts concluded electronically will produce all the effects provided by the legal system when consent and the other requirements necessary for its validity concur . Consequently, acceptance of these Conditions will have the same validity and effectiveness as any contract signed in person , this contract being admissible as documentary evidence in the event of a dispute between the parties.
MEERMIN reserves the right to carry out modifications and / or updates in these Conditions. In any case, it is deemed to User expressly agree to such changes or updates if you make a new order through the website , being the responsibility of the user read regularly, and that will be applicable here é llas that are in force at the time of completion of an order .

2 USER ACCOUNT.
The User will have the possibility to create a user account at any time through the "MY ACCOUNT" or "LOGIN" section, as well as once each order is completed.
Through the user account, the User will be able to find all the information of their orders, including the date of purchase, the invoice or the status of the order .
To create the user account, the User must have completed the corresponding form in which they will include the requested personal data and establish their own password, and must have accepted the MEERMIN Privacy Policy. The data provided must be in any case real and truthful, the User assuming any responsibility in this regard, and must notify MEERMIN in case there is any variation in them.
The user account will be personal and non-transferable, with the user holding the same full responsibility for use. Consequently, the User will be responsible for the proper custody and confidentiality of their password, and undertakes not to transfer their use to third parties, even temporarily, nor to allow access to third parties.
In case the User knows or suspects that his password may be being used by unauthorized third parties, he must change it immediately or communicate this circumstance to MEERMIN. As long as such events are not reported, MEERMIN will be exempt from any liability that may arise from the improper use of the user account by unauthorized third parties.
The User may unsubscribe from their MEERMIN account whenever they wish, by written communication to info@meermin.es .
MEERMIN reserves the power and the right to deny the registration of those Users who fail to comply with these Conditions and / or the applicable regulations.
3 CONDITIONS OF PURCHASE OF PRODUCTS .
Through the Website , the User may buy the different products in stock, such as footwear, belts and other accessories usually in stock , as well as request special products for MEERMIN to make according to their request and according to the User's specifications. These customized products are:
- Products of the groups " Made To Order " ( hereinafter " MTO " ) : These are special models offered for a limited time, and only made for those users who s had acquired during that period , upon individual request of these, and according to the size selected by each User .
- Products (in particular, footwear) of special sizes not usually available in stock and manufactured upon individual request by the User: that is, sizes from 4.5UK to 5UK or from 12.5UK to 15UK or their equivalents in other units of measure.
- Customized Products: These are special models, designed by the client on the basis of existing models in collection to which special characteristics such as change of type or color of leather, sole, type of sewing, etc. are added which makes them unique and produced for single customer.
The User will be able to buy any of the products through the Website, their prior registration in it not being mandatory. However, the Website offers Users the possibility of creating an account once each order has been completed, or through the "MY ACCOUNT" or "LOGIN" section.
To make a purchase, the User must be over 14 years of age, or, otherwise, must have previously obtained the authorization of their parents, guardians or legal representatives, who will be responsible for all acts carried out through the Site. Web by the minors in their charge.
The User may select all the products he wishes, which will be stored in his basket or shopping cart. Once all the products have been selected, the User must select their purchase code and click on the option “BUY NOW”.

If MEERMIN is unable to accept the order or for any reason the requested product is not available, MEERMIN will contact the User by email or telephone, offering the possibility of delaying delivery, replacing the product with a similar one or, in failing that, refund the full amount paid.
MEERMIN reserves the right to withdraw any products from l Site Web at any time , no s iendo liable to the User or to any third party for any such withdrawal. If the changes introduced interfere with the order made by the User , MEERMIN will notify you by sending an email or by phone to solve the problem . Likewise, MEERMIN reserves the right to limit or prohibit orders that may be made by distributors or resellers.
4 PRODUCT INFORMATION
All the products marketed are perfectly described in their corresponding product sheets, which the User can access by clicking on each product on the Website.
MEERMIN undertakes that the content, data or information related to the products offered on its Website are as accurate as possible, and will be responsible for the prices and characteristics advertised, although the User accepts that the Website will not be exempt from errors. MEERMIN will not be responsible for any information that has been introduced, displayed or modified by third parties outside MEERMIN.
Likewise, MEERMIN undertakes that the photographs, texts, graphics or reproduced characteristics that illustrate the products for sale are as close as possible to reality, although it is not responsible for the fact that they may vary slightly.
5 PRICE
The prices of the products will be those published on this Website at all times, the Owner reserving the right to modify the prices at any time.
The price of the products marketed on meermin.com is indicated next to the descriptive sheet of each one of the items and will be calculated in Euros (€) for orders made from the European Union and the UK*
* From January 1st 2021, the United Kingdom is no longer part of the European Union, and so all orders shipped to the UK will be liable to pay import duties, taxes & other charges upon receipt, based on the new trading agreement with the EU.
For orders placed from outside the European Union (other than the UK), prices are calculated in United States Dollars ($ USD)
Meermin currently supports the following currencies: US Dollars (USD), Euros (EUR), British Pounds (GBP), Australian Dollars (AUD), Canadian Dollars (CAD), Hong Kong Dollars (HKD), Singaporean Dollars (SGD), Swedish Krone (SEK), Norwegian Krone (NOK), Swiss Francs (CHF), Chinese Yuan (CNY), Japanese Yen (JPY) and Korean Wongs (KRW).
However, said price will not include shipping costs.
MEERMIN may periodically offer discount codes to its Users, which may be entered at the time of payment, with which the corresponding discount will be applied. Said discounts may only be applied in accordance with the instructions specified by MEERMIN with respect to each code, and in any case, Users may only use a single code per order.
6 PAYMENT AND BILLING.
Payment orders will be made at the time of purchase thereof (whether they are RTW products or groups MTO), through the means of payment chosen by the user, which may be: Visa, MasterCard, American Express, Diner's Club, JCB & Discover. As well as Apple Pay, Google Pay, Shop Pay & PayPal. Ideal, Sofort and other available payment methods at checkout.
In case of payment by credit card, the User guarantees that he is fully authorized to use it.
Once the full payment has been made, MEERMIN will send the invoice corresponding to the purchase made in the confirmation email that you send to the User's email. The User who has a personal account will be able to access the invoice through their account. By accepting these Conditions, the User expresses her express consent to receive the invoice electronically. If the User wishes to receive the paper invoice, they can contact MEERMIN indicating the postal address to which it must be sent .
7 CONDITIONS OF DELIVERY OF THE PURCHASED PRODUCTS.
Upon receipt of the confirmation of the relevant order, MEERMIN proceed to send the products purchased by the user to the address indicated by it at the time of ordering. MEERMIN is committed to delivering the products in perfect condition.
We inform you that MEERMIN will be able to send and deliver your products to any country in the world. Please note that depending on the country of delivery requested, the shipping and the delivery will be different.
The delivery times for orders placed within the Spanish territory will be:
- For normal product orders : delivery will be made between 24-48 business hours from the time the User received the order purchase confirmation.
Likewise, the User will have the option to choose a fast shipping option, at an additional cost.
- Product Ordering Groups MTO , special sizes or customized : L to delivery will take place between 2 and 3 months from the date of purchase , since their manufacture individualized for the user will be required . In the description of the product or MTO group itself, the estimated delivery time will be reported.
Users are informed that the stipulated delivery dates will be estimated and will not constitute in any case a breach of the obligations of MEERMIN assumed under this Contract .
The delivery times for orders placed outside the Spanish territory will be:
- For normal product orders: delivery will take place between 3 and 7 business.
- For orders of MTO Group products , special or custom sizes : Delivery will take between 2 and 3 months
In the absence of the recipient at the time of delivery, the carrier will leave a notice, indicating where the order is and how to proceed with its collection .
MEERMIN will not be responsible for errors caused in delivery when the delivery address entered by the User in the order form does not conform to reality or is false . Notwithstanding the foregoing, MEERMIN undertakes to adopt those measures that are within its reach, so that the delivery of orders can be made in the agreed time, and if not, as soon as possible, to the satisfaction of the recipient.
8 CHANGES AND RETURNS .
8.1. Products in stock:
In the event that the User is not satisfied with the products received, in accordance with the General Law for the defense of Consumers and Users, the User will have a period of fourteen (14) calendar days , counting from the date of receipt of the same , to change or return it s (withdraw from the contract) without need of justification and without any penalty.
In case of product change, the User must contact MEERMIN at info@meermin.es and indicate the new desired product, and MEERMIN will proceed to change it without additional shipping costs on the first change. In additional changes, transportation costs will be borne by the User. . However, in the event that there is a difference in the price of the chosen product, either the User must pay the difference in advance, or, where appropriate, MERRMIN will return the difference to the User after the change.
In the event that the User wishes to issue the right of withdrawal and return the product, the User must send electronically the withdrawal , or, if he prefers, any other unequivocal statement that he wishes to exercise his right of withdrawal, sending it to the address info @ meermin.es , along with a copy of your identity document. Once received, MEERMIN will inform the User how to proceed with the return of the product.
Products must be returned to the registered office of MEERMIN (or wherever the case may MEERMIN indicated) following the instructions on this, and within 14 days natural following the day he reported to MEERMIN the withdrawal , in the event of removal from a country belonging to the European Union . In the event that the User who makes the return is sending the product from outside the European Union , he must communicate the Tracking number to MEERMIN as soon as he has it to expedite the importation of his return with the Spanish Customs , being able to return it within a period maximum of 30 calendar days. The user is informed that all expenses arising from the import will be borne by the User.
The product to be returned must be in perfect condition, unused and with its bags and packaging. The User must bear the direct costs of returning these products and will be responsible for the decrease in the value of the returned goods in the event that they have suffered any damage or improper handling.
Once MEERMIN check that the product is in perfect condition, MEERMIN will refund the price of the product within 14 days natural following . The refund will be made through the payment method that the User had used to carry out the initial transaction , unless expressly stated otherwise.
In any case, the User will not incur any expense as a consequence of the refund unless the payment method they have chosen has any cost for MEERMIN , in which case we will inform them of its cost, which will never be greater than the one MEERMIN supports.
8.2. Products Group Made To Order (MTO) , special sizes and customized :
Without prejudice to the provisions of the preceding section for products in stock , the right of exchange and the right of withdrawal will not be applicable in cases where the User has purchased MTO products , special-size or custom footwear , in accordance with the provisions of article 103 of the General Law for the Defense of Consumers and Users, since they are products that are only made under the prior request of the User and in accordance with their specifications.
9 GUARANTEE OF CONSUMER GOODS
In the case of the reception by the User of defective products, MEERMIN undertakes to answer for the lack of conformity manifested by the User for a period of two (2) years from the receipt of the product, carrying out the repair or replacement thereof , or the realization of a reduction on the price or the refund to the User , as appropriate in each case. These steps will be free for the User.
The User must inform MEERMIN of the disagreement in relation to the product within two (2) months from the moment they became aware of it, through the e-mail info@meermin.es or through the contact form on the Website, sending a photograph that accredits the damage. MEERMIN will study the case and inform the User about it.
This guarantee will be applied taking into account in any case the nature of the products, as well as the provisions of article 116 of the General Law for the Defense of Consumers and Users, and may not be applied in all cases.
10 RESPONSIBILITIES.
The parties undertake to comply with their legal and contractual obligations generated under l as present s conditions . If a party does not fulfill any of its obligations or hinders the fulfillment by the other party of its obligations, the other party will have the right to claim compensation for the damages and losses caused, both for consequential damages and for lost profits.
The parties will be liable for the infractions in which they have personally incurred, the opposite party remaining harmless against any error, fault or negligence not attributable to it, and to any damage that may be derived from said infractions or errors attributable to the other contracting party.
MEERMIN will not be responsible in case of unavailability of the product or impossibility or delay in delivery when it is due to force majeure, theft or loss, or error in the order or data provided by the User and, in any case, for any reason that results alien to MEERMIN . However, in such cases, MEERMIN will immediately contact the User in order to find the best solution to the case.
MEERMIN will use all commercial and technical efforts to keep the products available through the Website, which constitutes an obligation that, however, will not apply to any lack of availability or performance caused by:
1) Temporary inactivity of the Website due to updating and / or technical maintenance, which will be previously informed by publication on the Website itself within a maximum period of 48 hours, provided they are known or communicated to MEERMIN with a period of advance higher than indicated;
2) Causes beyond MEERMIN's control : force majeure, Internet access problems, technological problems beyond the diligent and reasonable management of the Website owner, actions or omissions of third parties, etc.
In case of closure or suspension of the Website for reasons beyond the action of the parties, the User will be promptly informed of the transfer of the service to a new domain, modifying only the provisions of this contract regarding the domain in which the Website remains active.
It will be the responsibility of the User in any of the following cases:
- Do not make a false or fraudulent order. If it could reasonably be considered that an order of this nature has been made, MEERMIN is entitled to cancel it and inform the relevant authorities.
- Provide MEERMIN with the requested data, truthfully and accurately. By providing their data, the User gives his consent so that he can make use of them if it should be necessary to contact him. In case the User does not provide all the necessary information, the order cannot be formalized. If the User detects any type of error or outdated data, they must notify MEERMIN as soon as possible.
11 SAFEGUARD CLAUSE.
All the clauses or ends of this contract must be interpreted independently and autonomously, the rest of the stipulations not being affected in the event that one of them has been declared null and void by a judicial sentence or a firm arbitration resolution. The affected clause or clauses will be replaced by one or more that preserve the effects pursued by the Website Conditions.
12 APPLICABLE LEGISLATION AND COMPETENT JURISIDICTION.
Contracts made through this Website and these General Conditions are subject to Spanish law.
In the event that any conflict or discrepancy arises in the interpretation or application of these Conditions , MEERMIN and the Users, expressly waiving any other jurisdiction that may correspond to them, submit to the Courts and Tribunals of the city of Palma de Mallorca, unless the applicable legal regulations on competent jurisdiction establish another jurisdiction as an imperative .
